he distanced his rivals on the homestretch. In the law, persevering industry, with fair ability and good character, brings success.

The man of one book was once feared in the legal profession; how much he is to be respected in the future is an open question. Amidst the perennial crop of "yellow backed" text-books, special compilations and the reduplications, official, unofficial, compulsory, voluntary and -we might almost venture-imaginary, reports of cases, that thrust themselves in upon us in "pale, sickly calf" at the rate of five or six volumes a year, at as many dollars respectively per volume, the lawyer of one book who can sustain his text is to be commended.

Lord MANSFIELD, in The King v. Bembridge, 3 Doug. 332 (1783), said: "The law does not consist of particular cases, but of general principles, which are illustrated and explained by those cases." And even the admitted classics among our standard text-books are being too generally abandoned, or supplanted by the mushroom growth of compilations, calling themselves treatises on some of the most profound doctrines of legal jurisprudence. Every unfortunate prize essayist who graduates from our modern law school imagines himself an author, and some enterprising publisher, a deal sharper than the author, considers the cheapness of his essay a good advertisement and takes the venture. It is a matter of some interest, and quite significant in looking over text-books of standard authority that have gone through several editions, to find such names as Sharswood, Cooley, Ewell, Bispham, Heard, modestly inserted as annotators simply of American editions.

To encourage text-book study and personal research on part of the stu

dent, the writer has undertaken to furnish from time to time an outline of subjects that will appear in the columns of CURRENT COMMENT. There will be no attempt at pedantry, and, if we should err on the side of the very elementary, we will be sufficiently rewarded, if our suggestions assist any one desiring to put himself in the way of keeping up a systematic course of study.

In making choice of Kent's Commentaries as the basis for our text, we feel that we are placing in the student's hands "one of the ablest jurists and most profound commentators upon our laws," to use the language of Justice MILLER, senior justice of the United States Supreme Court, in his memorial oration on the Constitution of the United States, delivered at Philadelphia, Sept. 17, 1887.

These commentaries have passed through thirteen editions, the annotations of the last edition coming down to September, 1884, and are recognized by the profession as indispensable in American legal education. While in no way dishonoring the study of that standard law text to every English-speaking lawyerBlackstone's Commentaries-yet, the American student will acquire from Kent that spirit of the law so peculiar to our institutions and form of government, that no writer unfamiliar with our customs from actual contact and experience can give him. It is a pleasure to note the high legal attainments, and moral worth as well, of the two great commentators of the Common Law, the one of our mother country, and the other of our own. Chancellor Kent was born, 1763; admitted to practice, 1785; Supreme Court Justice, 1798-1814; Chancellor, 1814-1823; issued his commentaries, 1826-1830.
